Description of the Services Available
Children’s Aid serves New York's neediest children and their families at more than 50 locations in four of New York City’s boroughs, and in Westchester County. We provide a variety of services, support and programs, including prenatal counseling and assistance, as well as a broad array of ongoing support and resources for children and their families, which continues through the high school years, and includes college and job preparatory training programs (the “Services”). Our Website provides our donors and the general public with information related to the ongoing work of Children’s Aid.  It also provides a wide variety of resources and functionality, such as volunteering opportunities, blogs, as well as the ability to donate and get involved in advocacy campaigns. 

Registration; Personal Information 
You can visit the Website and access some of the resources, features and functionality without being required to provide us with any personal information. However, certain resources, features and functionality will require that you provide us with some personally identifying information about yourself, as more specifically detailed in our privacy policy, located here. If you opt to make a monthly, recurring donation, you will also have the option of storing credit card information in order to easily facilitate such future donations, as further described below.   

AGE REQUIREMENTS
Children’s Aid Website is intended solely for users who are 13 years of age or older, and any registration by, use of or access to the Website by anyone under 13 is unauthorized.  If you are under 13, you are only allowed to access this Website with your parent’s or guardian’s permission and supervision.  If you are 13 or older but under the age of 18, you should review these TOU with your parent or guardian to make sure that your parent or guardian understands them, agrees to be bound by them and you should only use the Website with their permission and under their supervision.  Additionally, you have to be 18 years of age or older if you want to conduct any type of financial transaction on the Website, and further provided that we reserve the right to limit certain other activities related to the work that we do – such as volunteering – to those who are at least 18 years of age.

Children’s Aid hereby grants you a limited license to access and make personal use of this Website, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Children’s Aid or as otherwise explicitly permitted. This Website or any portion of this Website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the express written consent of Children’s Aid. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Children’s Aid without Children’s Aid's express written consent. You may not use any meta-tags or any other "hidden text" utilizing any of Children’s Aid's name(s) or service marks without the express written consent of their owners.  We (or the respective third party owners of Content) retain all right, title, and interest in this Website and any Content on this Website, including any and all intellectual property rights. We (or the respective third party owners of Content) reserve all rights not expressly granted.  Any unauthorized use terminates the permission or license granted by Children’s Aid.

All other trademarks, service marks, trade dress, product names, company names or logos, whether registered or not, on the Website are the property of their respective owners. PAYMENT TRANSACTIONS
Payments and Payments Processing; Rules for All Payments
Children’s Aid Website provides the ability to make an online donation. Children’s Aid has engaged the services of both Blackbaud, Inc. and Cybersource, Inc., payment services providers, to process all donation/payment transactions.  These companies manage the routing of applicable customer information through the credit card and electronic check processing networks, as applicable.  Children’s Aid is not affiliated with either of these companies, and we are not responsible in any way for the actions or performance (or lack thereof) of either company.  Accordingly, Children’s Aid expressly disclaims responsibility and liability for all services provided by both Blackbaud and Cybersource, including those related to donation/payment transactions, and you hereby agree that Children’s Aid shall not be responsible for any loss or damage of any sort incurred as a result of any such services. 

You hereby acknowledge and agree that for all donations, (1) you will not use an invalid or unauthorized credit or debit card or other payment method; (2) all donations are final and non-refundable. Blogs; Acceptable Use for Blogs
Our Website contains blogs (“Blogs”). The content, view and opinions published in Blogs written by our personnel or contributors – or from links or Blogs that we post on the Website from other sources - belong solely to their respective authors and do not necessarily reflect the views of Children’s Aid, its management or employees.  Comments or opinions expressed on the Blogs are those of their respective contributors only. If you find any posts in these Blogs to be offensive or objectionable, please contact us via email at webmaster@childrensaidnyc.org and reference the relevant Blog. If we determine that removal of a post or posts is necessary, we will make reasonable efforts to do so in a timely manner.

GOVERNING LAW AND JURISDICTION

YOU AND CHILDREN’S AID AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS, AND THAT NEITHER YOU NOR CHILDREN’S AID WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, A REPRESENTATIVE ACTION, A COLLECTIVE ACTION, A PRIVATE ATTORNEY-GENERAL ACTION, OR IN ANY PROCEEDING IN WHICH YOU OR CHILDREN’S AID ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY. YOU AND CHILDREN’S AID FURTHER AGREE THAT NO PROCEEDING WILL BE JOINED, CONSOLIDATED, OR COMBINED WITH ANOTHER PROCEEDING WITHOUT THE PRIOR WRITTEN CONSENT OF YOU, CHILDREN’S AID, AND ALL PARTIES TO ANY SUCH PROCEEDING.

FORCE MAJEURE
Children’s Aid shall not be liable for any failure or delay in performance due in whole or in part to any cause beyond our reasonable control, or the reasonable control of our contractors, agents or suppliers, including but not limited to utility or transmission failures, power failure, strikes or other labor disturbances, acts of God, acts of war or terror, floods, sabotage, fire, natural or other disasters.
